1. Introduction 

These Terms & Conditions (“Terms”) govern your use of the tennis ball machine rental service provided by ACEIT ApS, CVR no. 46454723, Ved Stigbordene 7, 5TV, 2450 København SV, Denmark (“we”, “us”, “our”). By booking a rental through our website, you (“the Customer”, “you”) accept these Terms. 

2. Service Overview 

We rent out tennis ball machines on an hourly basis. The machines are located at partner tennis clubs. Each rental includes use of one tennis ball machine and the tennis balls supplied with it. 

3. Booking and Payment 

Rentals are booked online for a specified time slot at a designated tennis club. Payment is taken at the time of booking. Once payment is confirmed, you will receive a unique PIN code by which to unlock the machine at the start of your session. Prices include applicable VAT. 

4. Cancellation and Right of Withdrawal 

Please note that if you wish to cancel your booking, you must contact support@ace-it.dk. Cancellation of the ball machine rental will be refunded as a voucher for one free hour. Court rental is non-refundable under any circumstances. The machine may only be used in dry weather. 

Please note: Under section 18(2)(12) of the Danish Consumer Contracts Act (Forbrugeraftaleloven), the statutory 14-day right of withdrawal does not apply to services relating to leisure activities provided on a specific date or within a specific period. Our voluntary free cancellation policy applies in its place and is more generous. 

5. Use of the Machine 

You agree to: 

  • Use only the tennis balls provided with the machine. 
  • Operate the machine in accordance with the instructions displayed on or near the unit. 
  • Use the machine solely for its intended purpose (recreational tennis practice). 
  • Not allow any unauthorized person to use the machine during your session. 

6. Locking, Return, and Battery 

At the end of your session you must: 

  • Power down the machine and return it to its original position within the club. 
  • Re-lock the machine securely. 
  • Remove the battery and place it back into the designated charging station. 

Failure to do so may result in additional fees to cover lost rental time, recharging, or staff intervention, and may affect your ability to book future sessions. 

7. Liability for Damage 

You are responsible for the machine during your rental period and may be held liable for damage caused by improper use, negligence, or failure to follow the operating instructions — for example using balls other than those provided, exposing the machine to water, dropping or striking it, or tampering with its components. 

You are not liable for damage caused by normal wear and tear, pre-existing faults, or circumstances outside your reasonable control. Nothing in these Terms limits your rights under mandatory Danish consumer law. 

8. Malfunction and Refunds 

If the machine is blocked, jammed, or otherwise not functioning during your session, you are entitled to a refund. To claim a refund, please submit video evidence of the malfunction within 24 hours of your session to support@ace-it.dk. 

Once approved, you may choose between: 

  • A full refund of the session fee to your original payment method, 
  • A pro-rated refund for the portion of your session affected, or 
  • A credit toward a future booking of equivalent value. 

Refunds are processed within 14 days of claim approval. 

9. Tennis Club Rules 

The machines are located on the premises of partner tennis clubs. You must comply with each club’s rules, including booking court time separately where required. We are not responsible for access to club premises or court availability. 

10. Personal Safety and Liability 

You use the tennis machine at your own risk and should ensure you are physically fit to do so. We are not liable for personal injury, property damage, or loss arising from your use of the machine, except where such liability arises from our negligence or cannot be excluded under mandatory Danish law (including the Product Liability Act, Produktansvarsloven, and the Sale of Goods Act, Købeloven, where applicable). 

11. Lost or Stolen Equipment 

If the machine, battery, or balls are lost, stolen, or not returned to their proper location during your rental period, you may be charged the documented replacement cost. 

12. Personal Data 

We process your personal data in accordance with the GDPR and our Privacy Policy, available at https://ace-it.dk/privacy. By booking, you confirm you have read our Privacy Policy. 

13. Complaints 

If you wish to make a complaint, please contact us at support@ace-it.dk. If we cannot resolve your complaint, you may refer it to:

  • The EU Online Dispute Resolution platform: ec.europa.eu/odr 

14. Changes to These Terms 

We may update these Terms from time to time. The version in force at the time of your booking applies to that booking. Continued use of the service after changes constitutes acceptance of the updated Terms. 

15. Governing Law and Jurisdiction 

These Terms are governed by Danish law. Disputes shall be resolved by the competent Danish courts, without prejudice to your rights as a consumer under mandatory law in your country of residence.
